ORDERS are accepted by Vestige Costume Limited (referred to as ‘V.C.L’ hereafter) on the specific understanding that customers (referred to as the ‘Hirer’ hereafter) accept these terms and conditions.
PROCEDURES must be put in place to ensure costumes are well maintained, well cared for and looked after.
SMOKING AND DRINKING in costume is strictly prohibited.
DAMAGE CAUSED due to an incorrect use will be charged at the full replacement value. Should a controversy arise with regards to damage, the word and decision of V.C.L is final.
INSURANCE is the Hirer’s responsibility. The relevant amount should be sufficient to cover the full replacement value of the items hired. This can be discussed with V.C.L, if necessary. The Hirer will also be responsible for the hired items for the whole hire period including the collection and return of the hired items.
ANY INJURY that may take place while wearing costumes hired from V.C.L is the responsibility of the Hirer. Appropriate health and safety procedures should be put in place by the Hirer to avoid this.
The Hirer must indemnify V.C.L against any accident or damage.
A ‘COSTUME’ is all, or any article of clothing for any character in any show, performance or entertainment.
LOSS AND DAMAGE. The Hirer is responsible for the costumes at all times and a good care of the costumes must be taken throughout the Hire Period and any relevant extension. Should a loss or damage occur to the costumes the Hirer will pay their full replacement cost or value whichever is higher. An immediate notification in writing of any loss or damage to the costumes is required together with the payment covering the full cost of the replacement or repair which will be at the V.C.L ‘s discretion.
THE HIRE DEPOSIT. A deposit may be required for certain items. The refund of the hire deposit will be issued once every item hired has been returned and its condition appraised. This also applies to all accessories hired, including but not exclusively hats, ties,scarves, handkerchiefs, gloves, lacings and any hosiery.
RESPONSIBILITY will not be accepted by V.C.L] for any consequential loss or damage caused by errors, or by delay in delivery, or from any other cause.
FORCE MAJEURE. Every effort will be made to fulfil the contract with the Hirer except for a delay or a cancellation owing to an Act of God, weather, war, strikes or union action, lock outs, fire or any other cause beyond control which may result in an inability to provide the items and/or except at increased prices due to any of the foregoing causes.
ALTERATIONS. V.C.L allows to carry out some reversible alterations once agreed beforehand. However, the altered items have to be restored to their previous state before being returned to V.C.L. Should these alterations become irreversible or cause damage to hired item, Hirer will be charged the full replacement value of the damaged items.
FULL PAYMENT and settlement of accounts including all deposits, must be made before the costumes are dispatched, whenever possible and a purchase order number (PO) must be provided before the costumes can be released.
LAUNDRY. Most items on hire from V.C.L may require specialist cleaning. This must be discussed with V.C.L. beforehand. If there is any permanent damage caused by laundry then the full replacement value of the items will be charged.
RETURNS. Costumes must be packed for return securely and in a similar manner as they were sent for hire.
HIRE PERIOD is the length of time (including transportation relevant to collection and return) that the Hirer is in possession of the items. This will be discussed with V.C.L and can be decided for the whole run of filming or, till an agreed date or/and maximum up 8 weeks.
V.A.T. is chargeable at the current UK rate. A price list can be provided at the Hirer’s request and all prices quoted are exclusive of V.A.T (unless stated otherwise).
LATE RETURN FEES. Should there be a delay in returning the hired items by the agreed due return date and time then consequently late fees/additional hire fees (50% of the original hire fee), may be applied. This is at V.C.L’s discretion. Any further costs relevant to the delay, that are incurred by V.C.L, may also be charged to the Hirer.
